Terms of Use
This website (the “Site”) is operated by Presvelos Law Professional Corporation (“Presvelos Law,” “we,” “us,” or “our”). These Terms of Use, together with our Privacy Policy, govern your access to and use of the Site and any profiles, articles, publications, news, events, materials, and other content made available through it (collectively, the “Content”).
By accessing or using the Site, you confirm that you have read these Terms, that you understand them, and that you agree to be bound by them. If you do not agree, you must stop using the Site.
What this Site is, and what it is not
The Site exists to provide general information about Presvelos Law, its lawyers, and areas in which we practise. It is a public-facing information resource.
It is not a substitute for legal advice. The Content is general in nature, may not reflect the most recent developments in the law, and is not tailored to any particular set of facts or jurisdiction. You should not act, or refrain from acting, on the basis of anything you read on the Site without first consulting a lawyer about your specific circumstances.
Using the Site — including viewing the Content, sending a message through any contact form, or emailing one of our lawyers using contact details posted here — does not create a lawyer-client relationship between you and Presvelos Law or any of its lawyers, partners, employees, contractors, or consultants (collectively, “Firm Personnel”). A lawyer-client relationship is created only after we have completed our intake and conflict-check process and confirmed our engagement in writing.
Until that confirmation has occurred, any information you send to us through the Site or by email is not protected by solicitor-client privilege and we cannot guarantee its confidentiality. Please do not send sensitive or confidential information through the Site. If you wish to discuss a confidential matter, please call our office to arrange a proper consultation.
What you may do on the Site
Subject to these Terms, Presvelos Law grants you a personal, non-exclusive, non-transferable, and revocable licence to access the Site and to view, save, download, and print individual pieces of Content for your own personal or internal business reference, provided that:

your use complies with all applicable laws and these Terms.
That licence does not give you any ownership of, or further right in, the Site or the Content. Any use beyond what is described above requires our prior written permission.
What you may not do
You agree not to use the Site or the Content for any unlawful purpose, or in any manner that infringes the rights of Presvelos Law, our Firm Personnel, our clients, or any other person. Without limiting the foregoing, you may not, without our prior written consent:

Ownership of the Site and Content
All Content on the Site — including text, articles, graphics, photographs, video, audio, the firm’s logo — is owned by Presvelos Law or licensed to us, and is protected by copyright, trademark, and other intellectual property laws.
“Presvelos Law,” the Presvelos Law logo, and any related design marks are trademarks of Presvelos Law Professional Corporation. All other product, service, and company names appearing on the Site are the property of their respective owners.
Nothing on the Site should be interpreted as granting any licence or right to use any trademark, logo, or other proprietary indicator of Presvelos Law without our prior written consent.
Links to and from the Site
The Site may contain links to third-party websites for your convenience. Those websites are not under our control, and we are not responsible for their content, security, privacy practices, or availability. A link from the Site does not constitute an endorsement of the linked site, and you access third-party sites at your own risk.
If you wish to link to the Site from another website, you may do so for non-commercial reference purposes provided the link does not (a) misrepresent your relationship with Presvelos Law, (b) imply endorsement by us, or (c) appear in a context that is unlawful, misleading, or harmful to our reputation. We reserve the right to require you to remove any link to the Site at any time.
Modifications to these Terms or the Site
We may change these Terms, or the Site itself, at any time. The current version of these Terms will always be posted on the Site, and the date at the bottom of this page will reflect the most recent update. Your continued use of the Site after a change is posted constitutes your acceptance of the updated Terms. If a change is unacceptable to you, your only remedy is to stop using the Site.
We may also modify, suspend, or discontinue any part of the Site, including the availability of any Content, at any time and without notice. We will not be liable to you or any third party for doing so.
Risks and disclaimers
You access and use the Site at your own risk. We do not warrant that the Site or the Content will be uninterrupted, error-free, secure, or compatible with your equipment. You are responsible for putting in place appropriate measures to protect your own systems and data, including anti-virus protection.
THE SITE AND THE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT REPRESENTATION, WARRANTY, OR CONDITION OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, PRESVELOS LAW AND ITS FIRM PERSONNEL DISCLAIM ALL REPRESENTATIONS, WARRANTIES, AND CONDITIONS, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SITE OR THE CONTENT IS ACCURATE, RELIABLE, COMPLETE, CURRENT, OR FREE OF VIRUSES OR OTHER HARMFUL CODE.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PRESVELOS LAW AND ITS FIRM PERSONNEL WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SITE OR THE CONTENT, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
If, despite the foregoing, any liability is found to attach to Presvelos Law or any Firm Personnel arising out of or in connection with the Site or the Content, that liability will be limited, in the aggregate, to one hundred Canadian dollars (CAD $100).
Some jurisdictions do not permit the exclusion or limitation of certain warranties or damages. In those jurisdictions, the foregoing limitations apply to the maximum extent permitted by law.
Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them or the Site (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws principles.
You agree that any action or proceeding arising out of or relating to these Terms or the Site will be brought exclusively in the courts of the Province of Ontario sitting in Toronto, and you irrevocably attorn to the jurisdiction of those courts. Notwithstanding the foregoing, Presvelos Law may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property, confidential information, or other rights.
The Site is intended for use in jurisdictions where it may lawfully be made available. If you access the Site from a jurisdiction where doing so is unlawful, you do so on your own initiative and are responsible for compliance with local law.
General
These Terms, together with the Privacy Policy and any other notices posted on the Site, constitute the entire agreement between you and Presvelos Law in respect of your access to and use of the Site, and supersede any prior or contemporaneous understandings on that subject.
If any provision of these Terms is held to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force. Our failure to enforce any provision is not a waiver of our right to enforce it later.
A printed version of these Terms, and of any notice given in electronic form, will be admissible in judicial or administrative proceedings to the same extent and subject to the same conditions as other business records originally generated and maintained in printed form.
